(Amendment) Bye-Laws 2023
The members of the Ardee Municipal District in exercise of the powers under section 36 of the Roads Traffic Act 1994 and in the exercise of it’s powers under section 131A(1)(a) and paragraph 26 of Schedule 14A (inserted by section 21 (3) of the Local Government Reform Act, 2014) of the Local Government Act 2001 and all other enabling powers hereby makes the following Bye-Laws for the control and regulation of the parking of vehicles in parking places on public roads in the town of Ardee.
Part I
Preliminary

Short Title |
1. |
These Bye-Laws may be cited as Ardee Town Parking Control (On Street) (Resident’s Parking Discs Amendment) Bye-Laws 2023. |

Commencement |
2. |
These Bye-Laws shall come into operation on the (7th August 2023) 2023 |
|
|
|
|
|
Area of Application |
3. |
Bye Law 3 of the Ardee Town Parking Control (On Street) Bye-Laws 2014 is replaced with the following:
These Bye-Laws apply to the area comprising that part of the Town of Ardee as delineated on Drawing No : ACPR-02

Part II Resident’s Parking Discs
|
|
Non-Display of Disc |
9. |
If at any time while a Vehicle is left in a Time Restricted Parking Zone a valid Resident’s Parking Disc is not displayed on that Vehicle in the Resident's Parking Disc is not displayed on that Vehicle in the |
|
|
|
Relevant Position in accordance with Bye-Law 5, it shall be deemed |
|
|
|
that the Time Restricted Parking applies. |
|
Interference with Disc |
10. |
No person shall interfere or tamper with a Resident's Parking Disc. Any improper use of a Resident's Parking Disc shall render that disc |
|
|
|
void. |
|
Replacement of |
11. |
Where the Council is satisfied that a valid Resident's Parking Disc |
|
Disc |
|
has been lost, stolen, destroyed, or otherwise becomes illegible the |
|
|
|
Council or its agents will issue a duplicate disc (marked as such) |
|
|
|
upon being satisfied as to the authenticity of the Resident's Parking |
|
|
|
Disc concerned, whereon the original Resident's Parking Disc will |
|
|
|
immediately become invalid. |
|
Return of Disc |
12. |
A Resident's Parking Disc shall remain the property of the Council |
|
|
|
and upon a resident ceasing to reside at the address notified to the |
|
|
|
Council or ceasing to be the owner of the Vehicle in respect of which |
|
|
|
the Resident's Parking Disc was issued, the Resident's Parking Disc |
|
|
|
shall be returned by the resident to the Council. |
|
Transfer of Disc |
13. |
The Council may accept the transfer of a Resident's Parking Disc to a |
|
|
|
another Vehicle for the unexpired period of the Resident's Parking |
|
|
|
Disc following the surrender of the existing Resident's Parking |
|
|
|
Disc to the Council. |
